Ship Radar 24 – Terms and Conditions

These Terms of Use govern access to and use of the websites, mobile applications, widgets, APIs, data feeds and related services (collectively the "Service") of Ship Radar 24 Ltd ("Ship Radar 24", "we", "us", "our").
By accessing or using the service, creating an account, subscribing, or using an API key or data feed, you agree to these terms. If you do not agree, do not use the service.
If you are using the service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.
1 Definitions
"AIS" Automatic Identification System means transmissions and related messages, such as those broadcast by ships, coastal stations and other transmission sources.
"AIS data" This includes ship positions, identity, voyage-related fields and related information from AIS and other sources, including historical and real-time data.
"API" This means any programmatic interface, key, token, endpoint, SDK, data feed, stream, webhook or similar mechanism for machine access to content.
"Contents" This means all data, information, analyses, texts, images, maps, graphics, ship histories, diagrams, software, code and other materials available through the service, including AIS data.
"Paid services" This means paid subscriptions, premium features, API plans, enterprise plans, data feeds, or other paid offerings.
"Permitted purpose" This means (i) personal use of information or (ii) for business customers, internal information and operational purposes for your own organization, in each case strictly within the scope of your tariff and these terms and conditions.
2 Type of service and security notice
2.1 Information service. The service offers informative ship tracking and maritime intelligence from AIS data and other sources.
2.2 Not for Navigation Security / Compliance. This service and its content are not intended for:
- NavigationCollision avoidance, safety, or emergency decisions
- Compliance decisions where accuracy, completeness, or timeliness is required.
- Purposes where errors, omissions, or delays could result in personal injury, death, environmental damage, or property damage
2.3 Coverage and latency. AIS data can be delayed, incomplete, inaccurate, manipulated, or unavailable. Coverage varies depending on geography, reception conditions, and sources.
2.4 Service changes. We may change, suspend, or discontinue parts of the service at any time.
3 Authorization, accounts and security
3.1 Authorization. You must be legally able to enter into a binding agreement to use the service.
3.2 Account information. When you create an account, you must provide accurate information and keep it up to date.
3.3 Access data security. You are responsible for the confidentiality of your login details and for all activities under your account.
4 Service levels
The service includes:
- Free web access (with limited functionality)
- Paid subscriptions (Premium features for a set period of time)
- API and data feed services (programmatic access)
5 Free web access
5.1 Granting of licenses. Ship Radar 24 grants you a limited, non-exclusive, non-transferable, revocable license to use the service via the web interface for the permitted purpose.
5.2 No commercial exploitation. Free web access does not grant any right to commercial redistribution or use for the benefit of third parties.
6 Paid Services
6.1 Orders and scope. Paid services are provided on a prepayment basis according to an order.
6.2 Fees and taxes. All fees must be paid in advance. Fees are non-refundable and non-cancellable.
6.3 Fixed runtime. Paid services are provided for a fixed subscription period. Subscriptions do not renew automatically.
6.4 Single-session use. Each account allows access from one device/session at a time.
7 API and data feed terms and conditions
7.1 API access data. API credentials are personal. You may not share, sell, or publish them.
7.2 Prohibitions (API/Data). The following is not permitted without express written permission:
- Resale, redistribution or sublicensing of content to third parties
- Use of content for AI/machine learning or LLMs
- Creation of a competing ship tracking service
8 Derived data
8.1 Internal derived data allowed. You can generate derived data for internal purposes, provided that a reconstruction of the underlying content is not possible.
8.2 No reconstruction. You may not attempt to reconstruct content from derived data.
9 Permitted use
You must not:
- Extract content using automated means (except via authorized APIs)
- Bypassing payment blocks or technical measures
- Disrupt or excessively burden the service
- Using the service for illegal activities
10 Intellectual property
10.1 Ownership. The service and content belong to Ship Radar 24 or its licensors.
10.2 Feedback. By providing feedback, you grant Ship Radar 24 unrestricted rights to use it.
11 User content and photos
11.1 License. By submitting user content, you grant Ship Radar 24 a worldwide license to use this content.
11.2 photos. For submitted photos, you grant Ship Radar 24 a permanent, worldwide license to use, reproduce and distribute them.
12 Sanctions and export controls
You declare that you will use the service in compliance with all applicable sanctions and export controls. You may not use the service if you are located in a sanctioned country or are on a sanctioned list.
13 Disclaimers of Liability
13.1 As seen. THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE".
13.2 No warranties. Ship Radar 24 makes no warranties regarding accuracy, availability, or suitability for a particular purpose.
14 limitation of liability
Ship Radar 24's total liability is limited to the higher of (a) the fees you have paid in the last 12 months or (b) €100. Ship Radar 24 is not liable for indirect or consequential damages.
15 exemption
You agree to indemnify Ship Radar 24 against all claims arising from your use of the service or any breach of these terms.
16 Suspension and termination
We may immediately suspend or terminate your access to the service if we have reason to believe that you have violated these terms or pose a security risk.
17 Changes to the Conditions
We may update these terms periodically. Continued use after changes constitutes acceptance.
18 Applicable Law and Jurisdiction
These terms and conditions are governed by Bulgarian law. The courts of Sofia, Bulgaria, shall have exclusive jurisdiction.
Note: These terms of use apply to all Ship Radar 24 services, including website, mobile apps and API access.
